The report of mental activity can be judged as either true or false. But when we talk about the word like "promise", it will be judged as either happy or unhappy, because performative sentences (utterances) are judged in relation to certain conventions. These are;

  1. There must be an accepted conventional procedure for uttering certain words in certain situations.
  2. If a performative action is not dealt with social conventions then it cannot be jugged as happy or unhappy.
  3. All participants must execute the procedure correctly.
  4. All participants must execute the procedure completely (wholly).

By examining the term 'happiness', Austin claimed that there are different kinds of happiness found in the universe, such as;

  1. Infelicity
  2. Abuses
  3. Insincerity, etc.

All these forms unhappiness are derived due to the negative association with the facts or events of the world. Thus, it is not a new phenomenon for anyone since we live in the society. After deliberating on these types of unhappiness he made a "U turn" and offered a criticism to the distinction between constantive and performative statements. According to him,

  1. There is no real distinction found between the constative (descriptive) and performative statement.
  2. Thus, he abandoned the dichotomy between these two types of statement because of their overlapping character.
  3. Further, he stated that what we need is the theoretical speech act to deal with these two varieties of statement.
